Terms & Conditions

1. Introduction

Welcome to the website of Santa Cruz Mountains Winegrowers Association (“SCMWA,” “we,” “our,” “us”). By purchasing tickets, wine passports, or any other products or services through our website, you (“customer,” “you,” “your”) agree to be bound by these Terms & Conditions.

Please read them carefully before making a purchase.


2. Eligibility

By using this website or purchasing any product or service, you confirm that:

  • You are at least 21 years of age to purchase or participate in any event involving alcohol.
  • You have the legal capacity to enter into a binding agreement.
  • All information you provide is accurate and complete.

3. Event Tickets & Participation

3.1 Event Requirements

Event tickets grant entry to the specific event listed at the time of purchase. Some events may require:

  • Proof of age (21+)
  • Valid identification
  • Compliance with event rules and winery/tasting room policies

We reserve the right to deny entry to anyone who fails to meet eligibility requirements or violates event rules.

3.2 Event Schedule & Changes

Event schedules, locations, participating wineries, offerings, and details are subject to change.
We may modify or adjust events due to factors including, but not limited to:

  • Weather conditions
  • Winery or venue availability
  • Safety concerns
  • Government regulations

Such changes do not entitle customers to refunds.


4. Wine Passports

Wine passports sold on our website:

  • Are non-refundable
  • Are valid only for the dates or time periods specified
  • Must be presented at participating wineries as described
  • Are non-transferable unless otherwise stated in writing by SCMWA

Lost, stolen, or unused passports will not be replaced or refunded.


5. No Refund Policy

5.1 All Sales Are Final

All purchases made on our website—including event tickets, merchadise and wine passports—are final.
We do not issue refunds, returns, exchanges, or credits under any circumstances, including:

  • Scheduling conflicts
  • Illness or inability to attend
  • Weather conditions
  • Changes to event format or participating locations
  • Dissatisfaction with event offerings
  • Lost or misplaced tickets or passports

5.2 Event Cancellation by SCMWA

In the rare event that SCMWA fully cancels an event (not including rescheduling or modifications), we may, at our sole discretion:

  • Provide a credit toward a future event, or
  • Offer an alternative solution we deem appropriate

Cash refunds will not be issued.


6. Payment & Security

We accept the forms of payment listed at checkout.
By providing payment information, you confirm that:

  • You are authorized to use the payment method
  • The payment information is accurate

We use secure, encrypted payment processing through third-party providers. SCMWA does not store full credit card details.


7. Website Use

You agree not to engage in any activity that:

  • Violates applicable laws or regulations
  • Interferes with the website’s functionality
  • Attempts to access systems or data without permission

We may suspend or restrict access to users who violate these terms.


8. Intellectual Property

All content on this website—including logos, images, text, graphics, and branding—is the exclusive property of SCMWA or its partners and is protected by copyright and trademark law.

9. Assumption of Risk & Liability Waiver

Participation in wine events involves inherent risks, including but not limited to:

  • Alcohol consumption
  • Traveling between venues
  • Exposure to outdoor conditions
  • Personal injury

By attending any SCMWA event or using a wine passport, you assume all risks and agree that SCMWA, its staff, sponsors, and participating wineries are not responsible for:

  • Injury
  • Illness
  • Loss or damage to property
  • Any other harm arising from participation

Drink responsibly. Do not drink and drive.


10. Limitation of Liability

To the fullest extent permitted by law, SCMWA is not liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of use, data, revenue, or profit
  • Any claim exceeding the total amount you paid for the relevant purchase

11. Privacy Policy

Our collection and use of personal information is governed by our Privacy Policy, available on our website. By making a purchase, you consent to our data practices.


12. Governing Law

These Terms & Conditions are governed by the laws of the State of California, without regard to conflicts of law principles. Any disputes shall be resolved in the courts of Santa Cruz County, California.
